manufacturing probable cause
Can anyone tell me? I was pulled over for supposedly running a red light one morning at aout 2:30. I was later arrested for D.U.I. There was no citation issued for the red light fallousy. Could I argue that since no citation was issued, no infraction was in fact observed by the officer, thereby revealing his fishing motive, and subsequently tainting any further evidence? Help!!!

That would be hard to do...it is legal to stop you for almost any reason.
It may be wiser to hire counsel and let the experts try every technique available. You don't want this on your record. |
