THank you, He is an Irish citizen, he has a copy of his clean record from that country. He commited the offense in montreal, quebec, where he has no prior record.. He pleaded not guilty due to a bad advise from an attorney. He wants to plead guilty this time and do whatever the judge asks him to do as a sentence. My question is, how long does that stay in his record in Canada and how to get it expunged, generally, I thought that did not work for these types of offenses.....Thanks again....

THanks, again.
I thought clenaing a record (expunged) did not apply for cases like DUI. Here is the thing, he has an attorney, a public one, and he does not seem to care a lot, he asked for another one but turns out that the paperwork will take longer than his court appearance date, that is why I am asking all these questions. How can he ask for a clean record? Will that be after the sentence (whatever it is) is given to him or will it have to be after he serves or pays up the sentence? it is not that I want full details, I just want to give him enough information so he talks to his attorney in order to take the right route, not just to get it over with... It will ,, or rather, both will, remain on his driving record for anywhere from 7 to 10 years.
He will not get a "clean" record. I'm not sure why you're not understanding that. These offenses will both remain on his DRIVING record for 7 to 10 years and may very well affect his ability to obtain permanent residency. But that's for Canada Immigration to decide. Pleading guilty does not "clean" one's record. It is an admission of guilt. If everyone got a clean record for pleading guilty to crimes and offenses, prisons would be unnecessary. |

You are right, I did ( I do ) understand that the offense was made and therefore will stay on his record, no matter how he pleads. I am just trying to figure out a "best case scenario" for his future in Canada and the best route to take in the court appereance. As I said, he know he did something absolutely stupid and he is very glad no one was hurt, so he is just looking for the best outcome in order to continue his life here in Canada....Thank you.

You're welcome. Bear in mind that if his permanent residency or citizenship has not already been granted/established, Canadian Immigration can deport him. It may not happen, but it's best to be prepared for the worst case scenario. Canada has very strict guidelines on who they allow in their country even to visit. If you have a DUI from the U.S. they will turn you back and the border.
