Pointing out the obvious; the police did not "force" you to miss a day of work. You did with your actions.
Yes, you need an attorney but it's doubtful one will be able to get you off and keep you from losing your license. Your record, as you list it here, is becoming that of a habitual offender. The money you are spending in fines is nothing compared the an attorney's bill. You may be able to get legal aid, and that should help with expenses. But it's highly unlikely you will not face license suspension and even possibly jail time. |

That is something to be really proud off. Getting off a drunk driving charge and admitting to being "hammered". Your disregard for human life is astounding. One can only hope the only person you end up maiming or killing in your drunk driving stupors is yourself.

what if a foreign individual (with a legal status in canada) got pulled over and arrested for drunk driving and resisting (more like being difficult) arrest? I think he got bad advise and pleaded not guilty. He very well knows he is guilty and he repents (very much so). Now his court date is december (3rd time) and he thinks about pleading guilty in order to get it over with, however I now how much this will affect his record, and more so, he wants to apply to be a resident. He is clean now, productive and willing to go wherever he has to go in order to make this right...What should he do?

What he needs to do is show up for his court date, and accept the consequences of his actions. He's a habitual offender and it's highly unlikely because of his record he will be able to become a citizen.

I agree with you, however he is not an habitual offender, he has a clean record in Ireland and this is his first offense in Canada. Yes, he regrets it, does not even drive anymore. My question is more legal, what can he do in order to literally sets his record straight. He is going to plead guilty, I want to know what does that do to his record and for how long...thanks for the reply

Canada Customs will not even allow a person entry into their country for even some minor violations in the law that took place in another country. In their eyes, he's considered a habitual offender regardless of where past offenses took place.
The only way to "set his record straight" is to abide by the law and wait for these offenses to fall off his record. How long they will remain on his record varies from country to country. He could try to have his record expunged, and for that he will need to consult with an attorney. |
