1) I received a 3rd DUI in less then 7 years. The second and 3rd were within 11months. I had a high blood alcohol level .22

2) I was just pulled over last evening and was arrested with a BAC of 0.075 and they charged me for DUI. I had a prior in 2002 (7 years ago.) I think in 2005 the law changed to a 10 year Zero Tolerance/Probation period.

My question is since I received my first DUI in 2002 is this DUI that happened last night going to count as a 2nd since when I was arrested for my first one the probation period was only 5 years. Any help or extra suggestions on how I should go about it would be greatly appreciated.
