I was charged with Impaired Operation AND Over 80.
Is that normal? I blew 240. Single vehicle accident, I didnt hit anything, just went in a shallow ditch, no one was injured, I admitted to the officer on scene that I was intoxicated. No criminal record, first offense. Could I face jail time? Are those two separate offenses? As in, can I get a year suspension for one and then the other treated as a second charge (30 days jail + 2 yrs suspension)... I cant afford a lawyer at all, but dont qualify for legal aid, should I try to plead guilty to one to have the second offense dropped? Could that even work? Also, can I talk to the Crown Attorney, or can only a lawyer do that? If I plead guilty would I be sentenced immediately? I dont have any experience with the legal system, and Im terrified of getting railroaded because I blew so extremely high. Alot of questions, but any help/advise/personal experiences would be greatly appreciated! Regards, One humiliated ex-drinker |

Hello there -- sorry to hear about your circumstances. I know this is probably not what you want to hear, but you absolutely should not try and handle this matter yourself. Here is why I say that. This is a complicated case due to the speed involved, the high Breathalyzer result, the dual charges, and the accident. In other words, this is an aggravated DUI case and could bear some very serious and scary consequences. I realize your financial circumstances, but you do not want to deal with the Crown prior to at least sitting down with leagl counsel and exploring your options. Scrape together whatever you can for a half-hour consult -- plead with family, friends, use credit cards, whatever. There is too much at stake here. Go to the WLD main page and get a referral to an attorney in your part of Canada. It will be a modest sum which will pay off in ways you can't even imagine now. Hope things look brighter soon. AJJ
