My husband got his 2nd DUI in 10 years in January 2007. He refused a breathalyzer test...PA law gives an automatic 1 year license suspension for refusing breathalyzer. He rec'd the letter from PennDot stating his license would be suspended March 2007-March 2008. A judge sentenced him to 5 days in jail, 3 months house arrest, community service, a $5000.00 fine and counseling classes. Everything the judge ordered was completed by the end of 2007 with the exception of the fine which he's still paying on. (he is also on probation for 5 years and emails his PO every other week to check in) Last September 2008 he was driving and was pulled over at a routine stop. The officer ran his license and it came up suspended=he explained the DUI/jail/etc and said his license was reinstated in March 2008-officer said he had to go by the info he rec'd and drove him to his dad's house-officer was very nice, told him he'd receive a citation from a local DJ and he'd help him in any way that he could. Ticket arrived a week later for $550.00-he called PennDot who said they never rec'd proof he did his jail time/community service, etc. so we figured we had to resend the paperwork to PennDot. He went to the DJ's office to discuss what to do..the employee said the citation showed a suspended license due to DUI which was an automatic 60 day jail sentence-he explained everything-didn't matter. It's now July 2009, his hearing at the DJ's office is next week. He has retained his DUI attorney who gathered all of the paperwork to show the DJ that he met all of the requirements and PennDot apparently didn't lift the suspension as they should have-their error. Even though the attorney has all of the paperwork to show he did everything he was sentenced to (again, still paying on fine but the PO is aware of this...) I'm still paranoid he is going to be in trouble. His attorney says PennDot messes this stuff up all the time. I guess I'm looking for reassurance this can be dismissed at the DJ's level w/o going to court? Thank you!
