Florida - My husband is a Priest, and one of the men in our church is in jail for a DUI. He has been in trouble before. A while back, he fell 3 stories from a building, and now he is having seizures. He claims that while driving, he was having another seizure of some kind. He evidently ran a red light. He admits to that. The police thought he was drunk. Two police searched him, searched the car, and found nothing. They cuffed him, put him in their car, and fifteen minutes later, they took him back out, still cuffed. Then the police said they found a pill in their own squad car. He was not drunk, but he had a seizure. One report states they found nothing, the other said they found the pill in their own car. One report states he had an alcohol level of .08, the other report said .24. Our friend said that they did not do a breathalyzer test on him at all, but the police state that he refused the test. He also claims that they are putting the wrong statement, wrong day, and wrong officer before his first appearance judge. The other two officer's statements in this case were not read at all. They are using a previous report from a month before, when he was walking down the street drunk, and he was not arrested. My husband wants to write a letter to the Judge on his behalf to get him the medical help he needs. The public defender will not call my husband back. The reason he wants to speak to the lawyer, is to receive insights on how to make the letter more effective in helping him. Should he write the letter anyway? Is there any hope for this person?

The Public defender is not required to talk to yoru Husband.

It would be by far better if private counsel were involved. And that counsel may work with all of you to resolve.
PDs just don't have time in many cases. |
