OWI Second Offence Michigan
I have recently been charged with an OWI second offence.
I was bonded out of jail and have not been arraigned yet. I don't know if I will be eligible for a court appointed attorney and do not have the money to hire one. I was blacked out during my whole arrest and a good portion of being in jail. In fact I do not remember leaving the bar. I am always very conscious about calling for a ride when I have been drinking considering I already have a conviction of OWI. I am curious if anyone thinks that explaining to the prosecutor about being blacked out and not being in a 'cognitive' mind will help me be offered a lesser plea bargain? Or if not the prosecutor... who should I tell this information to...? if anyone. I plan on pleading NOT GUILTY at my arraignment and explaining this as my defense... Any input?? |

To be honest, I'm not sure being "blacked out" is the correct tactic to get out of being charged. You most definitely are guilty of drinking and driving. The only thing I would think of is you drank way too much. Or you could have been drugged, but you would have probably been too lethargic and weak to drive. You ARE applicable for a court appointed attorney. Some of them are actually pretty good. Your looking at around 90 days but the jails are so jam packed it's ridiculous. Your best bet would probably be to admit to rehab. Or atleast ask for it. I'm sorry for your plight, I as well just caught my second OWI. Good luck. Remember, this is michigan, the legal system is so screwed it's absurd. If you go in there saying you were blacked out, your looking at AA, camps, outpatient rehab, and jail time. So stick to the "you have a problem BS" and get into rehab. It's better then the dirty jails with crackheads and lice. Once agian, good luck!
