I was pulled over and issued an ovi a month ago and am waiting for trial still. I was recently pulled over for driving under a suspended license. However the officer profiled me and pulled me over. It was at night, could not tell it was me driving as i had a passenger and was so dark out, and had no reasons to pull me over until he ran my plates and saw that i owned the car. Thus he believed i was driving pulled me over saw it was me and gave me the ticket. Is it legal to profile someone like so?

It is an illegal stop. The cop was in violation of your 4th amendment rights; unreasonable search and seizure. Same thing happened to me but I got off because my lawyer argued that point.

The police officer likely had a reason, such as perhaps weaving, driving too slowly for the speed limit, obstructed plate light even.
Police, especially in small towns, have been known to run plates of people they're behind. If you were the registered owner of the vehicle, and he ran your plate, and your license came back suspended (often associated with registration info), the officer had every reason to suspect your car may have been stolen. Imagine his surprise (or perhaps not considering the vast number of people who drive after license suspension), when he discovered you behind the wheel. It is not entrapment. There really is no such thing as entrapment anymore. Other poster, where do you see the original poster said the officer seized and search either his vehicle or himself? I can find that part. |

Actually, in the state of Ohio, for an officer to run your plate it is not a violation of your 4th Amendment Rights because the vehicle plate is on the OUTSIDE of the car, there was no intrusion of privacy. And according to case law, the owner is presumed to be the driver. Look at Rocky River v. Saleh, that should explain it
