2nd offence MIP

I am an 18 year old living with my mom in nebraska and this is my second MIP offence. my buddy and i had been drinking lightly and were on our way home and we got pulled over for a busted headlight. the deputy was in a hurry because he was the only cop in a small town and had another more important call. he informed me of the headlight and looked down to see the two open containers. he did not breathalize me or my friend just took the two containers, dumped them out, took our licenses and keys and told us we could get them back at the courthouse/police station. i got a call this morning and i now have an MIP. i got one 2 summers ago but took and completed a diversion course. my question is what am i looking at as far as a penalty? can i take diversion again?

Class III misdemeanor with up to $500 fine and/or 3 months in jail or up to ten days of work on public streets and in parks.

im 16 years old and i got my first mip when i was 14 and i did an 8 hour class for it and it was cleared. then when i was 15 i got another one and was assigned to the jade program which i am still in and last thursday i got my 3rd mip while i still havent gotten my second one cleared. what is the punishment i could face?
