2nd dui in 5 years, hit and run, refusal

I got my first dui in June 2004, and now charged with another one in October 2008, along with hit and run and refusal. I hit someone's car and came home because I was scared. They called police who showed up at my house an hour after I had gone to bed. They asked had I drink that night and I said yes, I had three beers and I also take depression meds that make me sleepy. I explained that I had been asleep for an hour all ready. They then arrested me for all of the above.

What are the chances that my lawyer can get this to count as a first offense, or even a wreckless? I am very scared about the jail time because I do have a small child (who was not with me at the time).

There is a chance--and maybe with some counseling or treatment classes. You really MUST hire a lawyer here and one with a lot of experience with these DUI cases.
