Dui

I received a dui in colorado a few days ago. I was found asleep at the wheel with the ignition on. I was at a house party and decided to sleep it off in my car rather then drive home. I fell asleep at 5-6 am and cop later knocked on my window at 8:00 am. I took a blood test howevor have not recieved my results. Im anticipating the worst .20+. I am under 20 first time dui with no other criminal or driving record. Any thoughts on what the penalty will result in. Possible Jail Time? Thanks

I do not know Colorado Law, but I had a very similar case here in Florida. In Florida the legal drinking age is 21 so the presumption of impairment is much much lower. I can not answer your question about jail but I can tell you that a good dui lawyer can better advise you.

My case involved an older man and a much younger women who left a party and he was way drunk. Rather then drive he and the girl slept in the car with the car running so they could use the heat. ( It was a rare Cold Florida Night) Anyway I argued that he did what we would expect people in a similar situation to do because of his alcohol consumption, slept it off rather then drive. The problem is that in Florida having keys in the ignition is sufficient for "actual physical control" which is one of the elements. I argued to the jury that because the car was not in gear and was simply running he was not operating the vehicle nor was he in actual physical control because the car wasn't moving.

Jury acquitted him. Much to my surprise.
