I live in Nebraska. I was pulled over, my headlights were on the parking lights. The cop smelled alcohol he asked if I had been drinking I said no, I was giving my friends a ride home from a party. I had to take a soberity test and a breathalizer I passed both. He gave me an open container charge,followed with an MIP. He said I did not show up on the breathalizer and just gave me the ticket and told me I was free to go. I really don't want this on my record I am planning on going to grad school later down the road with an mip I can't get in. Will I be able to get the charges talked down because I wasn't drinking to were it won't show on my record anymore.I don't care if have to pay a fine, take a class, or community service. I just won't to be able to go to grad school. It is also my first offense. I am also wondering if I should get a public denfender or lawyer? Please help

In some states, a simple first-time MIP without any other circumstances (such as driving or public intoxication) may only involve a fine of $100-500. Often fines are reduced or eliminated provided the person convicted completes a program such as alcohol education, probation, or community service. In some states, a fine is eliminated, supplemented or accompanied with a loss of the accused driver's license for a period of time ranging from 30 days to 12 months.
Assuming you don't have any other, and don't get any more, criminal convictions you may apply to have your conviction set aside after X years have passed from the date of your conviction. |
