Default Possession in Ontario

So here's my situation: I'm an adult, living in Ontario. I have no prior criminal history (execept a 'warning' that comes up in the police computers when they run my name.) I was caught with 4-5 grams of marijuana. I'm not sure if I was officially arrested or not because they let me go but they did say 'you are being arrested...' They gave me a ticket that says: Notice to appear in court, person not yet charged. What should I do? I don't want a criminal record because I travel to the US frequently. What's most likely to happen if I plead guilty? I've read on other websites things like theres no law against small possession for personal use in Canada, and cases have been thrown out on those grounds. Can anyone tell me if this is true? or at least shed some light on what it might be touching on. Also, on another site, I read that convict someone of possession charges you need to prove that person knew what they had was illeagle, does this mean I can say I didn't know it was an illeagle substance? Lastly, my notice to appear in court, does that mean that I have to go to court and then they set another date when my charges are dealt with? or is everything dealt with on that date? Any info that could help me would be greatly appreciated, Thanks in advance.

Default Re: Possession in Ontario

You really should have a lawyer review your entire case and then try to negotiate a solution that will keep this minor offense off your record.

We would not advise trying to clear this up alone.
