how do they get away with using the law for own malisios prosecution

my brother was wrongfully accuesed of a crime, and when he proved he didnt do it , the D.A., started messing with him any way possible, including using children services. he was staying with me and my oldest brother. i let him use my truck for a couple days then when he gave it back a day later a friend and i went to mt apartment late at night while it was raining real hard so we sat in truck for a few minutes when i noticed a car facing my appartment in courthouse parking lot, next thing i know im being held in my vehicle waiting to be searched for being suspicious charachter in my own parking space, now i am being prosecuted for 5th degree felony of possesion, what do i do

Well you can try to argue there was no reason to search you but it may be weakened by the fact they did find something. They can say something you did alerted them. And they will say that!
