3rd offense possession

My boyfriend was recently arrested with just over 44 grams of marijuana on him. They impounded his truck and arrested him, he was out on bail in hrs but my question is this...I have been reading up about the NJ laws and came across the 3 strikes law, Im not sure if this would fall under that law and if so it states 25 yrs to life inprisonment!!! I am scared and really need to understand what he is up against and maybe a ball park time frame of possibly how much jail time he will likely get. He wasnt selling, the officer ran his plates and saw he had an expired license. Any advice and answers you can give me I'd truly appreciate...thank you

In NJ in order to have the last strike hit it would have to apply to a conviction pertaining to murder, robbery &/or carjacking. It would mean mandatory life in prison with no parole. The offenses listed don't include drug possession.

Even tho drug possession is sometimes listed as a felony it is rarely regarded as a "strikable offense." Each states has different law regarding what is a "strikable" offense.

Usually the law was designed to get violent offenders off the street.

As far as I know I think your okay.
