Guilty by Association---Juvenile

My 16 year old cousin was arrested for marijuana WITD within 70 feet of a school. However, the marijuana,the scales, and the baggies were found on his friend, who is a legal adult, and who has taken full responsibility for the marijuana. Even though, the investigator charged 3 of the 4 boys involved in the traffic stop (all for the same charges mentioned above), for some unknown reason they immediately released a 21 year old who was riding with them.
Should there be any worries considering that he had no drugs or periphenelia on him, that he is a juvenile, and the information already mentioned? The vehicle, which was impounded after an unlawful search (no request to search the vehicle was ever asked), does belong to the mother of the above accused if that is of any importance. This is his first charge for any illegal activity.

You still want to make sure that the issue is dropped and not in any way on his record.
