I have yet to get a lawyer and may have to use a public defender due to financial issues. My friend and I were pulled over while he was driving and we had 4 freshly cut down marijuana plants in 3 garbage bags. We were told by the officer that he could smell it while driving behind us. I was charged with possesion for the purpose over 3kg and production over 3kg. I do not have a criminal record and have worked for the same company for 20 years. I dont see how the production charge can stick as they have no proof that we produced it and also as far as trafficking goes I have no criminal record. The weight of the three bags was over 50 pounds but that was full plants wet. It probably would have been about 4-5 pounds once dried and trimmed. I have sleep apnea and find that smoking helps me sleep better. I am thinking about trying to enter a plea bargain for simple possesion but then I will have a criminal record. I am not sure what to do. Any thoughts. Also it was my friend that was driving his vehicle and I was the passenger.

I was totally silent. However my partner said a few things. On my disclosure it states that I exercised my rights to remain silent.

Make sure you get legal counsel (or at least the public defender) to try to keep this off your record eventually--jail time is not likely if your record is clear now. But having that arrest and/or a conviction on your record could make job-hunting etc. more difficult. Often this could be negotiated down to some kind of court supervision or even be dismissed etc. If it eventually appears it cannot be negotiated down, or you need to discuss this in more detail with senior counsel to review options etc., please let us know...
