On April 20, 2006 i was arrested with possession of 3 oz of marijuana with intent to distribute (felony) in Florida. On July 3rd, 2006 I agreed to an adjudication withheld on the charge. At the time i was 22 years old. I was on probation for a year and finished with no problems. Now I 24 and want to join either the Army, Navy or National Guard. I have done research and there are waivers for a lot of different felonies in the military, but ITD is a non-waivable offense. I called my lawyer and told him if I knew this at the time I would have never agreed to the offer. If it would have been a felony possession I would have a change to get a waiver. He said that he will call the prosecutor and see if she is willing to change the charge from ITD to a felony possession. Is this even possible after 2 years? Is there anything else I can do to get the ITD dropped? I know that expungement is a civilian procedure and the military will still see the ITD.
