Confused can I make him leave?

I have been married for 5 years and have 2 kids from this marriage (2 & 5) and 2 teenagers from my previous marriage. My husband inflicts every kind of abuse on me except for the outright physical abuse. Occasionally he shoves, pokes or throws things but he's smart enough to not leave any evidence that could make this all much easier for me. Right now it's a he said/ she said thing and he's quite charming when he needs to be. He is a drug abuser/ alcoholic who spends much of our income while I work two jobs trying to prevent foreclosure. he comes and goes as he pleases often for days at a time while he's on a binge. I want to know what I can do to get rid of him. I feel like I work hard for what I have and I don't want to be the one to leave (with all the kids) and just hand it all over to him. Isn't there some abandonment law where if he's gone for so long I can legally make him stay out?

I would suggest if this is a serious problem and counseling will not work, that you file for divorce now and ask the court for emergency temporary orders that will protect you and ensure housing etc. until the divorce is finished (and you have divided up the assets).

If he is abusing you-chances of him getting "assets" are slim to none anyways. If he's abusing you, you need to call the police and speak to a "victim's advocate" right away & find out what you need to do. Also there is TONS of info. on the internet too. If you have time when he's gone. Come up with a plan after speaking with an officer and let him know what to do. The BEST way to assure you're safety & the kids, house, etc. is to let him know the cops are closely watching. Let them know asap. If they try to just let him stay and cont. not believing you, etc. mention "lawsuit", they'll kick him out & let him know he has to leave. You should be protected under spousal abuse laws. Call the cops & a lawyer ASAP.

Get out ASAP if you are that unhappy. Nothing is worth that.
