My wife is a resident of New York (and has been all her life), I am a UK resident. We were married in New York over 6 months ago and now want a divorce for irretrievable breakdown. We have both agreed to divorce and have no assets to separate- what is the easiest, quickest and cheapest way to divorce? I know the NY state site has the forms for uncontested divorce but I believe you need different ones for an international divorce- where do we get them from? And will I be able to go through the divorce process without having to visit NY?

I wish to inform you that divorce can be granted in New York. If you will not be personally present in hearing or if you do not reply then default judgment may also be granted. Therefore you can have a divorce in New York without going to New York. If there is a consent between parties then relief granted to wife will include all mutual agreement.

In uncontested divorce when parties are self represented, the court may require the personal appearance of both parties to swear the signatures on the petition on theirs and that they want the dissolution, the marriage is irretrievably broken. You may check with a NY family law attorney for advice on what verification the court will require. If personal appearance is required in the county or borough where the petition will be filed, or special authentication of your signature since you are in the UK, the lawyer will so advise. You may also be represented by an attorney to appear for you to finalize the divorce, which would mean you would not have to travel to the U.S. |
