Default Adultery in AZ if there is no sex involved

While I know what the laws in Arizona are concerning adultery, my question is, is a married man who is friends with another woman and NOT having sex considered to be commiting adultery? And is the accuation alone of the man commiting adultery enough for a court to decide if he is or not?

In other words, if there is no sex involved, is the man commiting adultery in the eyes of the law?

I wish to inform you that if there is no sex then there cannot be said to have adultery. The allegation alone is not sufficient. It is necessary that there must be evidence which clearly show that there was sexual relation between parties. It may be proved by evidence of person or through medical evidence. Simply making of allegation is not sufficient.

Arizona is one of the states that has criminalized adultery, that law still on the books, making it a misdemeanor for a married person to have sex with another. Adultery is defined as intercourse. So, without intercourse, there can be no adultery.

Thank you for clarifying that. I know there are a lot of gray areas when it comes to this, but I also know that the courts don't really like to get too personal about these things.

There have been some prosecutions in AZ under this adultery law. But the definition is clear that intercourse is what constitutes adultery. Clinton could not be prosecuted under it.

And reading between the lines of the above answers, you would have to prove intercourse had taken place. The only way I could see you could do that would be if the lady got pregnant and you could prove the child belonged to the other party. How else could you prove it?

There are other ways of proving adultery; video taping, a witness to the event, confession of one of the parties, are some of these. Pregnancy could be conclusive, but not necessary.

What if he admitted to kissing her? Can i prove adultery if the other woman used my computer, left email open and i found chats between my husband and her referring to having affair and i printed them?
