Common law wife, IL USA
Divorced in 1992 under irreconcilable differences with no claim to purchased home, however continued and currently living together on same address for 22 years, both parties always worked, raised 3 sons, all of them over 21 two of them now in college. Common law wife wishes to separate and would like to know if there are any grounds to claim any part ownership on home, car or business, due to not being named on any title.

I wish to inform you that as divorce has occurred in 1992 therefore there is no further rights. Further Illinois Marriage and Dissolution of Marriage Act (750 ILCS 5/214) states that common law marriages contracted in Illinois after June 30, 1905 are invalid. However if a person has been staying in the house as owner then rights may be taken as ownership by adverse possession.
