I found out that my husband is bigamist. I am first wife and we have kid, lives with me in Europe. He is Indian, married once more in USA without divorceing me. Our child is born in USA and also there is house bought on his name ( with morgage) during our mariage and common life. During we are separate ( 3 years) he didnt ask for kid and didnt send one cent to our kid. I have from lawyer here document where he signed that he will care about kid in his absent and 30 % of every advancement and in a case of saleing house 50% should go to our kid. Till now I didnt ask him for divorce, and didnt ask him for anything as he always do with blackmails, and usually doesnt do anything and I am tired of it.
Now, when I know that he did this crime I have no idea to accomplish in it. What should I do? Do I need to hire some lawyer in USA? Can I also charge him for not sending anything to our kid and dont care for it, as all one year he even didnt make phonecall. Please help! |

I wish to inform you that bigamy is an offense in the United States. Bigamy occurs when someone willfully enters into a second marriage while that person is already married as was your case. In 37 states in the US, it is a felony. Further, as you and your child live in Europe you may file for Divorce, Child Custody and Child Support in the County Court of the County where your husband resides in the US. You may submit all the facts to the Court. In the matter of Child Custody and Child Support, the Court will always consider the best interest of the child. The Court will consider all the facts and decide the matter.

I would like to inform you that a person who knowingly commits bigamy is guilty of the crime. Bigamy is illegal in all states and territories of the U.S. The crime is punishable either by a fine, imprisonment, or both, according to the law of the individual state and the circumstances of the offense. You can approach a lawyer.

What you can and should do is report him for bigamy to the authorities where he is residing, giving all the facts and proof you have of prior marriage before he contracted the one in the U.S. Certified copies of your marriage registration. It is not clear from your post whether the bigamist husband is in the E.U. or U.S., though, so clarifying that point would be helpful. |

Child is born in IL, our last common place where we were staying together is CA and right now he is in MN. Kid and me are in Europe.
He is Indian resident still. Few days ago, by himself he told me that he married, with woman with whom he is staying for more than one year in MN. Like that he got greencard and a job and can stay in USA ( he was in panic as that woman found about me and kid. I strongly belive that he told her that he divorced me, and made her Ok). He was in panic saying that without her he cant live in USA. Yesterday he discard his saying telling me that he is only staying with that woman and he is on visa. What I strongly belive that is lie. He aslo blackmailed me yesterday not to do anything stupid othervise I will be in problem and not geting anythin for our kid?! What is situation about it? Is it possible to freez status of his accounts and property in USA in that case?! What can happen with him in a case that he made bigamy? Is it possible to check by number of his passport and his biodate his status in USA and did he marry to get gren card?! |

As for child support, if there was never a court order issued that required him to pay child support, then he would not have been legally obligated to pay a dime. Even if you file with the courts to seek a child support order now, you would only get child support going forward if it was ordered at all. You would have to file for child support in the jurisdiction where YOU reside, not where he lives - and depending on what country you are currently living in, it may be difficult, if not impossible to actually enforce an order on someone living out of the country.

Bigamy is a felony in the U.S. If he is here on visa and has any hopes of becoming a citizen (like through his bogus second marriage), being convicted of such a felony should end up getting him deported. Back to the E.U.
After he gets out of jail. Report him. |
