i started filing for my divorce in florida in february they lost my paperwork and then i had to report my money order lost and get a replacement which took a month to get back and i moved in april to south carolina so i got the money order i sent it and the resigned paperwork back to florida in june then a couple days ago they said my case was dismissed cause i moved . My ex lives in Tennessee, we have been separated for 12 years, we have 2 children we want to file a uncontested divorce all she wants is her last name back which is fine between the both of us my 2 kids stay with my mom i pay a 100 a paycheck to the kids support. I really need to get this divorce done and finalized before april cause i am getting married again what do i need to do i have less than 6 months to do this please help.

I wish to inform you that divorce can be filed in the state where either of the party resides. In this regard you may file divorce in your state or your spouse state. As you have just shifted to Tennessee thus it may be difficult for you to show residence in this state and therefore divorce can be filed in the state of your spouse. For residence you are required to show that you stay in the residence for 6 months.

how long does it take for a divorce to finalize if we start the process this week i live in south carolina and my ex wife lives in tennessee since she has been there longer i have to file in tennessee I'm just worried that i won't be divorced before my wedding date

You will not meet Florida's residency requirement to file in Florida in the time period you wish. Your wife will have to file in the state she is residing in, providing she meets the residency requirements -- OR you may file for divorce in Nevada. They have no waiting period. Grounds include being separated for at least one year which you more than meet.
Nevada does as much divorce business almost as gambling. My suggestion is that you seek a divorce in Nevada. When there are children involved there is a mandatory counseling session. However, one may seek a waiver of this requirement. There is a lot of information online about getting a Nevada divorce as well as lawyers who can advise and handle the matter for you if you wish. |
