Default Separation: Is my husband allowed to move in cause half the house is his?

common-law husband left 6 weeks ago moved to a trailer park and my daughter and myself reside at our house both on mortgage last week i was charged with assault on him first charge in my life, was told by officer to abstain from communicating with him now he left a note at my house that is allow to move by in cause half the house is his and he can do that the police report said i reside at house he just rents the garage for the propose of his business and must leave before i get home from my job, is he allow to do this he said he talked to a lawyer today and he can move by just does not talk to me so i don't get in more trouble

You need to file for divorce and get an order (restraining order) that he not come within Xyards of your home. A judge can do this as a temporary order until there is a full hearing on the matter and eventually a division of property made.

One thing to remember: When someone gets a lawyer, you need to get a lawyer. Otherwise you are at the mercy of both and defenseless.
