Almost a year ago, my wife and I had agreed to a divorce. She agreed to sign the paperwork. I got the paperwork. She changed her mind. I agreed to wait 90 days to see if I change my mind. I never did. My wife agreed about two months ago to move out and sign the paperwork for a divorce, only on the condition she has another place to stay, and money saved up to move out.
My wife started a job this last week. My wife had met with an elderly lady and her son almost a week ago. I agreed to pay for gas and food for 6 weeks if she left. According to my wife, rest of the bills were paid for. Three days ago, my wife had left to go live with an elderly lady. She called today saying she could no longer live with the elderly lady. Reason given was that there was porn all over the house. I ignored the phone call, and did not answer. Earlier, about 6 hours ago, my wife came knocking on the door and wouldn't stop until I answered. She explained that she could no longer live with the elderly. She came in for a few minutes, then left, apparently to find other options. This was about 4 hours ago. About 30 minutes ago, my wife called saying she had no where to go. I did not answer the phone, as I was still asleep. I sleep during the day since my work hours are overnight. My wife came pounding on the door, I ignored her. She came in anyway. I no longer want her here. I do not believe my stuff is safe, as she has torn up and thrown away my stuff. What are my legal options? I even feel blackmailed, since she will only sign the paperwork on the conditions I previously listed. |

I wish to inform you that divorce itself does not mean that your wife will have to leave house. She may stay in the premises. In this regard if your wife has left the house to live with elderly woman then you may claim that she has lost possession of your premises and therefore you may refuse entry. As the house is generally regarded as community property therefore your wife may demand division of house. Further your wife may not damage your things and you may claim compensation in this regard.
