I live in Indiana. Is there any way to slow the divorce down. I was told Friday that it could be finalized in another 30 to 50 days. They have also told me that the No contact order from the courts will not be lifted for another 60 to 90 days. Is there any way to stop or slow down the divorce until I can talk to my wife. I still do not know the reason Why we are getting a divorce. Seems like the law should not allow it to be finalized until people are allowed to talk. Seems like there should be a 30 day cool off period first and at least 4 sessions of Marriage counseling before the courts agree that it should be done. The papers state that is a irreversible differences. How do we know until we talk or get counseling. I do not want a divorce.

I wish to inform you that you can slow down the process of divorce. In this there are many issues which may not have been resolved. Therefore the creating of unresolved issues normally delays the divorce. While pronouncing divorce the court settles the issue of bringing an end to marriage. Therefore, lastly you can ask for judicial separation instead of divorce. This may enable you to have time and resolve the issues between both of you.

Sorry to say, but people are not forced to be married if they do not want to be. One person in a marriage wanting out is all that is required for a divorce to be granted. Judges do not force people to stay together or force people to mediate when one is opposed.
Your spouse is obviously resistant to any reconciliation attempt, and has apparently made up her mind she wants a divorce. She appears uninterested in further communication on how to keep the marriage intact. That is her right. The divorce will proceed as planned. Both parties have to be of the same mind in communications regarding the possibility of remaining married. Since your spouse is not interested in such communication, no judge will force her to do what she has no desire to do. It is not the courts deciding all you believe it is deciding. It is the decision of your spouse. It would be in your best interest to give her what she wants, and perhaps down the road, communication lines will open between the two of you. It's desperate to hang onto an emotional relationship with another when it no longer exists and the other person does not want to be in that relationship with you any longer. Let go gracefully. |
