Default Husband locked me out of family home

My husband and I are from uk, but live in Canada, our marriage has been breaking down since feb 09, in December twice he got violent with me and i called the police on once incident, i came to england to visit family and especially my dad as his health isn't so good. whilst over here my husband called me saying he has changed all the locks to i can't get back into the home. says his lawyer advised him to do this. he is packing all my clothes and he has cut off my phone, and cut me off of any money, says he isn't supporting me anymore, so i don't have a penny, without my phone cannot work. he says i have to go to a refuge. we have 2 children 6 and 9 in the family home. i just don't know where i stand in getting back into my home with my children.

He cannot do that, and I highly doubt any attorney who does not want to have his license to practice law either reprimanded or suspended advised him to do that either.

You live at the residence, and as such, he cannot force evict you without first going through a court of law to do it. While he is within his legal right to change the locks on the house, you are also within yours to hire a locksmith and change them so that you have keys to access.

He also cannot touch any of your personal possessions.

Your mistake was failing to have him removed, via a court of law restraining order, when he got violent with you and police were called. You also made the mistake of leaving the country (regardless of the reasons) leaving this mess behind.

You are free to go back home. If you have to, have the police escort you back in. Your husband is trying to intimidate you with threats and lies, and do NOT take his word for anything he says that he claims came under the advice of his attorney. Tell him to give you the name, address, and phone number of his attorney so that you can validate his claims.

The police WILL escort you back in.

I did the same last year! Worked perfectly.

maybe u are an alcholic, child neglecting man using adultress who went to england soley for a screwing lots of men holiday and your husband is the only true parent yoyr children have left then i suspect locking u out is in those childrens best interest so i guess legally you have to screw someone new to get want you need since its obvious you are a liar i can smell it on your post

ridiculous postings, the mother left the home for twoweeks if in that time the father has chosen to change the locks in order to sperate and seek a divorce legally he has the right. the police will not want to cause a domestic incident and will escort the mother to a womens shelter wher she can live, eat and seek free resources, ie social assistance, legal aid and counselling.
marital breakdown in never cut and dry and you must await a courts decision before yoy can make any changes to your situation. it would be best to seek shelter with a relative or friend while seeking legal counsel for who is entitled to remain in the marital home as well as custody, access and marital assets. good luck locked out of my home it s going to be a bumpy ride!!

It would be nice if the bitter, angry people drinking at night to drown their frustrations and sorrows about their lives would refrain from using their computers while doing so.

The two above posts, obviously authored by the same person, are a good example of what really is considered hateful speech, and as such, should be deleted by the forum administrators. It is replete with personal feelings and projection.

Further, nothing in either diatribe is accurate. The husband cannot lock the wife out of her own home legally. If the husband wants a divorce, he is free to file, but to do so in such a cowardly fashion (unless he is scared of her) warrant protective action. The wife DOES have every right to have the police escort her back into the home, and she DOES have the right to change the lock again so that she can gain entry into her own home.

You cannot simply kick a person out when they are away from home, regardless of why they are away, and touch any of their personal possessions. If the drunkard believes otherwise, try it and see how fast you wind up in a court of law being sued over it.
