Default Name on deed

In Georgia (now living in La) I have been divorced for over 10 years, when i left i wanted just my freedom and my kids, however, the judge said that my ex had to give me something on the land and home that we bought together while we were married. The loan was taken out in both of our names, the deed was put in both of our names, and as of today it looks as though on my credit, that i am still paying for the land and home, in other words, the loan is still in mine and his name. He has not refinanced and i have never signed off of the property. He informed me the other day that my name is no longer on the deed, however, it is still on the loan. He said he is unable to finance the loan right now due to the economy. How can my name have legally been taken off of the deed. The judge told him to pay me $5,000 or $6,000 when he either sold or refinanced the land and the home. I now am fighting cancer and they have threatened to put a lien on both the land and the home, and he said that they couldn't because it was no longer in my name. If I never signed off on it, how can that be? The divorce papers stated that he would take full responsibility for the loan and the upkeep, and when either sold or refinanced he would have to pay me. Is it possible that the deed no longer has my name on it?

Why are you simply taking his word for it? He wants you to believe your name is no longer on the deed so that he doesn't have to pay you to remove it when he sells and/or refinances it. In other words, he's suckering you.

The real reason he is unable to refinance the loan is because your name is on the deed and he would have to receive your signature to remove it, and therefore have to pay you. He is well aware of this, but does not want to pay you any money in exchange for having your name removed. His credit is probably also bad, which leads him to believe he cannot refinance due to his bad credit. His credit score is probably very low.

If in doubt, simply go online and research your local county's registry of deeds website, or simply make the trip there and ask for a copy.

Unless he has managed some form of trickery that is little known, your name is still on the deed. Nobody can remove your name except you.
