I have a divorce judgement for "Indefinite Spousal Support (SS)" in Oregon. I would like to retire at age 59.5. There will be one child at age 20 that I will support thru college thus exceeding any child support requirements so I do not think my child will demand that I pay child support as if that happened I would not support her college aspiration.
My questions are: 1. Since this has to be revisited by a judge will they make me continue to pay SS since it is doubtful that my ex will work. She is able bodied and capable but elects not to work. Additionally she at that time will have received in excess of 5 K per month for over six years. 2. Supposing I work until age 62 and then draw social security. In that scenario my ex will have received the SS for over 8 years. Can my wife take a part of the social security if she has a judgement against me? |

There must be some reason for the SS. was she asked to try to begin looking for work?
She will not get you social security normally but something has to change or there has to be some reason to stop the spousal support given how your order is set up. |

The support was indefinate as it was a greater then 15 year marriage. In Oregon the non working benificiary of SS has that right to request it that way. Thus it requires revisitation. My ex is able bodied though not highly trained. She could command some sort of work. 2.5 years post divorce she elects not to at this point. I would like to retire in another 2.5 years at age 60. I need to know if the court will still mandate that I pay her ..essentially mandating that I work. Sort of a from of indentured servitude.
