husband has been missing since 1979
my husband has been missing since 1979 how do i declare him legally dead. or do i need a divorce?

You can ask a court to do so but more likely they will say you should divorce unless you have some evidence he is indeed dead.

What State do you reside in? Have you involved the police? A detective?, to see if there's been any activity with his Social Security Number?
If he's been missing since 1979, that's an awfully long time to go without moving on with your life. Some States have certain time limits before declaring someone legally dead. This is why I ask what State you live in. 30 years. Wow. Did you ever file a missing persons report in all that time? |
