EEK! False PFA? It was filed under false pretenses.

A PFA was filed against me a year ago.
I only learned recently it was filed under false pretenses, and false information.

The only person who knows this is the other party, who now has a guardian, a TCM, an attorney, and a mother, who keeps her from speaking up fully.

Is there anything that can be done at this point?
I've already been given 2 ICCs for talking to her and helping her relax, and wonder what can be done to challenge the PFA.

Thanks!

How old is this person?

Stop talking to this person. You are only getting yourself into deeper legal trouble. You do realize these orders are part of your record, correct? It can affect your ability to get a job, or even get an apartment of your own. It can affect your ability to travel to different countries.

No matter what you feel for this person, stop talking to them.

Consult an attorney on how to proceed in having the order lifted.

Angry re: False PFA? It was filed under false pretenses.

She's 20, but somehow the mother convinced the courts that she is not mentally capable.
Yet she was not given a fair chance to challenge it. Her mother was always in the room w/ her and her defense attorney. Her mother had her attorney's number and she didn't, and so forth.

The way she's being treated isn't fair, regardless how I feel about her, since noone cares what she wants or says anymore.

Life isn't fair, and it's best if you get used to it now. Fairness is just a made up word for children.

It's apparent that she is mentally impaired. If not, she would not still be under a parent's control so heavily. Does she live with her mother still? If she's not mentally impaired, then she's certainly playing you for the consummate fool, as this would mean she knows exactly what she is doing and doesn't care. At the age of 20, she should be able to break free from her mommy and make a life for herself. She should be capable of speaking for herself instead of allowing her mother to do it for her. If she hasn't, and her mother has been running her life, then she IS mentally impaired and that is why the courts were convinced. No normal 20 year old lives the way you describe this woman as living.

People have to live with the decisions we make. Feeling sorry for anybody who hoisted legal trouble, resulting in a criminal record, upon you is just wasted emotion. Stop feeling sorry for this pathetic wench and get on with your life. Your first step in growing into adulthood is to stop feeling sorry for people who do you wrong.

She was never given a chance to speak out.
Her attorney was under the control of her mommy when she got guardianship of her
Even her new guardian is in her mommy's control it seems.
And the psychiatrists who mentally evaluated her were paid by her mother.

Everything in this situation was biased against her (and I can vouch for her, cause I've witnessed it take place).

Now that she tries to do anything, the judge won't even listen to her, because of all these "issues" that the various psychiatrists and such that has been said against her.

What you're not understanding is there must be some validity to this guardianship and the 20 year old is obviously mentally impaired. Otherwise, she would not be able to be so controlled.

Most 20 year olds can speak for themselves regardless of who is trying to silence them. It's not a conspiracy against you. You are not going to be able to do anything for her whatsoever. You have no legal recourse.

The only thing you can do is petition the court to drop the PFA, citing that the woman was too incompetent to bring such an action. What you are saying here, bring to the court's attention. You must have proof of these allegations, however, before the PFA can be dropped.

By the way, who actually filed the PFA against you and for what reason?
