I am contemplating filing for a divorce. Currently I have an open harassment case with the EEOC. It is very likely that I will be remedied monetary compensation my for pain and suffering. If I receive this monetary award before I file for divorce will I have to forfeit half of it to my husband? We live in a community property state. It does not seem right that he would get half the money for something that I suffered solely. If so, is there any way for me to protect myself from this happening?

There are a lot of things in Divorce that don't seem right or fair, but as the law stands in your State, if it is a community property State, you will probably have to split the money with him, or he may get an amount less than half.
If there is some way you can hold off settling and receiving the money until after your divorce is final, you will not have to split the money with your ex. |
