Default HELP FAST!

Does anybody know if a spouse had his own account before marriage with money in it, gets married and then spends that money on just day to day stuff during marriage with his partner is he entiltled to claim a deduction on this money now in equalization??

My ex is trying to claim that he had money in a separate account before marriage then he spent it during marriage on me and things now he is trying to claim that money back.

My lawyer said he can if he kept this money separate, and has proof . I am arguing with my lawyer stating that he spent in during the marriage why should he get it back, so he benefits it in the spending process for himself and me and now gets a refund on it?? It does not make sense nor is it fair. Along with many other deductions he is tryng to claim. He also received a navy pension after he quit the navy when we married, he received that cheque during the marriage and spent it on a vehicle for me we purchased a van since we were starting our family he then got my vehicle and I had the van, although he had ownership to it , can he claim this money back? This guy is trying to get a deduction on the entire marriage. What are your thoughts please let me know before I find myself another lawyer.

No he does not get that back...if he spends day to day it is his choice to use it in that way--as opposed to say savings accounts etc.

But, it was in his own saving account before we married and then he consumed it in the marriage, can he still claim it as a deduction if you look at the divorce act (ontario) it stipulates in their in regards to the marital home and who is on sole title etc (which is him) that their is a loop hole for the first marital home and then purchasing another to enable for this deduction due to him,
can you please help me with this because my lawyer is stating that it is law and I don't know wether to believe this or not..
