Confused Is separation required in uncontested divorce-NJ?

Finally I and my husband agreed to divorce. My question is do we need to live apart before filing for uncontested divorce? I mean is separation required, if so for how long for NJ?

I have read in another thread that uncontested divorce can be done without a lawyer. Can somebody tell me how to do this..like what should be the papers and procedure. Atleast any website link where I can find proper info. Currently, we are both living together in New Jersey.

You might check the forms on this site; they can be seen for free and have an instruction sheet as well usually.

In an uncontested situation, you can do the paperwork and represent yourself without a lawyer. You can find the paperwork and information you need at the clerk's office of the courthouse.

To answer your question, no you do not need to be separated in order to file for an uncontested divorce. NJ has a law that allows you to file for a divorce for "irreconcilable differences".

There are several sites online that can help you prepare the required legal forms. I came across www.divorce297.com
