Default My ex wife entered my house!!!

I am in the process of divorce. The papers have been filed, and we are waiting the 90 day period in Texas. I have the locks changed and my ex wife has already come through the house and gotten her things. The house is in my name only, and always has been. While was out of town on buisness, I forgot to lock the back door, and she came by and removed things from the home. Some were hers and some were mine. Is there anyhting that I can do. She knew that she had no right to be there, and I was open about her collecting her things, and was not trying to withhold anything. Can I call the police...and just so you all know...she cheated on me...lol.

How are you married in Texas and she is not on the deed? Where you married after you purchased the house?

Regardless, in Texas it is a community property state. She owns half of the home. As for the police, do you have any protection order baring her from the homestead? If not, she is free to enter “her” house.

As for taking your property, it needs to be brought up during the divorce or a civil suit can be filed. Your property is yours.

Are children involved?

there are no children involved. and yes, i owned the home before she moved in. we did a "quicky" divorce and she took her things and I kept mine. We agreed on everything when we signed the divorce papers. When she got her own apt, I changed the locks, and when the papers were filed I figured that we were finished. She knew that I was out of town, and found a way in...there is nothing I can do? It is my fault for leaving that door unlocked...

If you want this type of "entering" your property to stop for sure then you may wish to file a police report. From what you have written, she relinqusihed her right to be there or to your possessions.

At least then you have started a paper trail of her actions.

I would also see about an alarm system. They are installed free, give you two keypads (front and back) and no one can then enter your home without you knowing again. It is a minimal monthly payment for such a secure feeling.
