after a 12 year domestic partnership that ended in infidelity, my partner abandoned the relationship and our home. She continues to pay 1/2 the mortgage, but does not maintain the property in any way, shape, or form or reside in the home.
The house is now up for sale. Upon the sale of this house are the contents considered "mine" because she abandoned the relationship and possessions or are they to be split 50/50? How is the law written? If she pays 1/2 the rent but doesn't reside on the property do she "live there"? If I have maintained the property for the last year, am I entitled to a higher percentage than 50/50 when the house sells for taking care of the property? |

If two or more owners cannot agree on what to do with a piece of property they may petition the court and the court will order a sale or refinancing etc. so that the one or more may get out of the property obligation and/or the other(s) may keep it etc.--it is often done-- (This is true in some cases even for equitable owners that have paid various amounts etc., but for various reasons, may not be on title.) You could threaten to take this action if need be. It may cause compromise which is of course what you need here now.
Roughly it will be a 50/50 split minus whatever you each paid or contributed in the beginning. |

I owned my property 7 years prior to relationship then had a 91/2 year relationship which ended up her cheating and leaving. She has not paid a penny on the property on any of the bills that came with it or has she been her or even tried to arrange half payments for 21/2 years, now wants to force me to sell and wants half of everything. Can I get her for abandanment?

You cannot "get her" for abandonment (not abandanment). You own the property and you are not married to her. The property is in no way hers. She cannot "force" you to sell property you own solely. Her wanting half of everything? Tell her people in hell want ice too, but they're not ever going to get it. What she wants and what she can realistically get are two entirely different matters. I assume you never added her name to the deed. |
