Mine is an arranged marriage,been married for over 8 months of which the initial 2 months went thru travelling and meeting relatives etc etc.It was kinda rocky to begin with as I did not get the utmost honesty and truth to start with even though that was to be the foundation of this arranged marriage.Anyways took me over 5 months to get to the US post my visa paper-work etc etc.I have recently moved here and have experienced total aloofness and bit of a attitude problem from my husband.
Some background will help.My husbands ex and children stay an hour away and he supposedly is not on good terms with his ex.Though she wants him to divorce and get back with her I only get denials from him.In addition to this my husband is a alcoholic and hence suits his own convenience to walk out of the house and not return for two days at a go.(Supposedly thats not sucha big deal out here in the states and I have culture issues to raise any questions on such a behaviour). In addition to this he works at times 2/3 or maximum 4 days a week, we stay at the mercy of my mother in law as all that I was told about him earning a decent living is yet to take place and he struggles with managing his own expenses along with his child support for two kids. Now coming to me, I am a aimbitious hard working woman and have over 14 years of work experience and was looking for a loving stable house to come and settle in and pursue employment in the states.With the recent developments and my understanding of my marraige I feel we are at a dead end as my husband would rather be out drinking up with his buddies than working towards making a success or atleast getting the marraige to a tsable ground. I need to understand my options if I would want to file for a divorce what are the impacts to me personally as I am awaiting my SSN and dont a drivers license and dont have a job yet but have recently received my Green Card. I want to be able to get a job and work a good living for myself rather than go back home with a failed marriage and have to be reminded of it with every passing day by people around.I am capable of taking care of myself and not being a burden to anyone else.Please advise what the process is and If a divorce now after a months stay in the US will impact my future and citizenship in the country. |

I am not a lawyer so this is only an opinion, but if you say you have a green card and can prove that the marriage was in fact legitimate and not immigration fraud (only to get the green card) i think you have a chance of keeping your green card status. I will keep looking for answer and let you know if i come up with anything.

Firts .. If u are a greencard holder you are authorized to travel and work in US ...
2nd .. In case that you have a provisional-condicional permanent residence / greencard if you get divorce without goodcause before 2 yrs of marriage you are putting on higth risk your status. 3rd ./ His conduct could be qualify as a a kind of domestic violence but you have to start a procedure/sue in a family court, it could takes yrs and yrs, you need a lot of proffs, and you dont have any waranty that u will get your permanent residence under this way ... In my opinion if your marriage is legal , the best way is try to get counseling and wait until you get your permanent residence x 10 yrs ... after 3 yrs of been married you could apply for citizenship ... otherwise u need to way for 5 yrs as a permanent resident ... Love can everything .. even make u forget "smal" problems ... help your husband and contact AA !!! .. about his ex - dont worry .. american girls luv making your life miserable !! lol I am not a lawyer but have a situation alike hope this can help you ... |

I have the same problem, and i need guidance in this regard. I m green card holder and having spouse immigrant visa. Now i m residing at my native country, i want my green card and visa safe after divorce. I am taking divorce within a month probbably through court, but i want myself safe. I ve no kid. and it was an arrange marriage i stayed in usa after marriage only 2 months and 16 days.
Kindly guide me. |
