I am going through a divorce in SC, where my husband admitted on paper in court that he has a girlfriend and drinks daily, which are the grounds I filed on "Adultery" and "Habitial Alcoholism". He doesn't want to give me any of his retirement funds, so he says he is going to prosecute me for fraud as I signed checks out of his account to pay bills and such because he would not put my name on the account and the bills needed to be paid. My paychecks were directly deposited into his account. He says that he will put me in jail before giving me any of my share of marital property (house, retirement, etc.). Can he do this? I was told that he couldn't as we were married...
He did not fight me over the custody of our son and would rather be with his girlfriend than with his son. He is only worried about materialistic items. Any answers would be appreciated. Thanks SC |

The court will accept that as fraud if he knew you were doing it and acquiesed.
I would not worry about that threat too much. |
