Default Living in Spain

Hello, I'm british and have been living with my family in spain for 6 years. The marriage is at an end - we both agree that this is the case. I will return to the UK with our 3 children, all minors. I was going to do this once the house is sold here. My husband has agreed verbally that I will keep the house less 10 thousand euros, but dosent want me to involve a solicitor, saying he'll create problems for me if I do.

I had intended to take the children back to the uk for xmas to visit family, but my husband tells me he will also be in the uk during this time "re-uniting" with his ex-wife. I have no problem with their new relationship, but he wants us to continue living together after christmas, pending the sale of the house here in spain.

I find this unacceptable. He thinks I'm crazy. I found out that he has infact invited his ex here to spain during christmas, again I find this unacceptable.

I feel drained, I think I should stay here now, even though I cant support the children financially, in case he moves her in. Any advice or law would be great. Many thanks MD

have you filed for divorce?

move out or get the court to order him out--which it may very well do!

thanks for the advice, I filed for divorce 6 years ago in the uk and found out that the papers are still with the court - so once back in the uk I can push this forward. I did speak to a lawyer here and I just have to get him to leave which he says he will at christmas. I'll change the locks and hand the keys over to a neighbour who will supervise viewings till the house is sold.
