Divorce & Marriage in Kuwait

My GF/Finacee has Kuwait citizenship and officially married in Kuwait. Her husband has outright cheated on her and she has physically caught him. She has been trying to divorce for over a year but he refuses to do so. She has been trapped and very scared not knowing how to get out.
We plan to marry once everything is settled but it has been very difficult and looks like there is no way out for her. Is there any way for her to get out of this situation? What are the possiblities if she went to the USA and we married is there anyway for he to claim anything for her to get out of her current marriage? Example I know there is a way to claim fear to return to your home country due to certian reasons? Or is there anyway she can clain she can not locate him and file for divorce that way. I know that can be done in the USA but not sure how it would work internationally?
Is there anyway to help us? She has been trapped and trying to get out for over a year. This is a great hardship on her felling so trapped and helpless.

If she ens up in the USA she can divorce there, whether her husband agrees to it or not!

In order for her to divorce in the USA I would have to bring her to the USA and she would have to become a USA citizen first correct? She currently has Kuwait citizenship. I cant not find the Email address you are refering to?

No not necessarily; if she legally resides here under any status it is possible she can divorce

i think the poster meant use world law's home page to ask that question and get a specific lawyer you can deal with for follow up etc

How could she legal reside in the USA with out USA citizenship? The only way for her to enter the USA is under her travel visa but I do not belive she can legal reside in the USA under that visa?

I had 2 daughters with my previous 5 yrs live-in partner in the philippines the first one carries my family name and the second one carried his family name; we did not have any legal papers at all and recently he kidnapped my younger daughter (the one whos carrying his family name) and never let my family see the kid because he found out that i married a kuwaiti guy here in kuwait. for what i know he doesnt have any right to do that because we werent married.right? what should i do? i want to keep all my kids intucked together.... now at the end of this month i will have a baby boy from my kuwaiti husband shouild i be afraid?

I have a friend that is going through the same situation. the problem is she is not kuwaiti. She is from Indonesia and her husband is from Turkey. He has beaten her and keeps her in home, lets her go to work and then takes all of her money. What are he rights as a TCN here in Kuwait? She has a Civ Id, i believe 20, but her current job will be getting her a Visa 18. She has been married to him for quite sometime. What are her rights and what possible course of action does she have for obtaining a divorce?

She can legally reside in the US with a permanent resident card/green card or any visa so long as the terms are not violated and it has not expired. If she has Kuwaiti citizenship, it is unlikely she will marry a foreigner. She wont have the same luxuries and nor will her kids... hard for Kuwaiti to give that up...

If her father is Kuwaiti, that means she's originally Kuwaiti.You must make sure that she is a Kuwaiti citizen in order to marry. Kuwaiti women or men may get married outside, under government's policies. SHE WON'T be allowed to divorce her Kuwaiti husband there. It's maybe hard; but not impossible. She have to divorce from him, she must go to court in order to divorce. If she'd get married in a foriegn country she needs to have a contract and permission from the Kuwaiti Ministry of Justice.
