Default marriage null and void

On December 7th 2000, I got married to my boyfriend { not happily}, staying in my neighbourhood, with whom I had an affair. It was completely his plan and neither of our parents were involved in it. I never came to know how he arranged to marry in an arya samaj mandir and had brought all legal papers. I was informed just 1 day before marriage. It was in Delhi Shalimar bagh. I went to my college as usual and he picked me up with 4 of his friends and wife of 1 of them. It took around 1-25 hrs and I came back home the same day at around 3p.m., the normal time of my return.

I did not tell anything at home and lived in a normal manner. On 15th my mom had some doubts that I talked to that guy again, as once she warned me of not talking to him. On 16th my complete family came to know about the marriage as that guy sent his friends to inform my parents.



As my parents were not ready, we sat in gurudwara for punchnama settlement, in which I signed along with 4 other people of society to declare the marriage null and void. But that guy did not sign it and went away from there. In jan 2001 we filed a case , praying for marriage to be declared as null and void. 6th feb was the first date given for hearing on which I gave my statements against that guy.



The case is dismissed on 21st July 2008 as the judge took heavy amount of bribe.



My question to u is



Since I did not went to his home for even a single day, can I get some benefit of divorce?



My lawyer, who is mother’s sister is not willing to put the divorce case as she thinks that the other party will put a maanhani case, if we accepted the marriage?



If we accept the order of the court, even though its not in our favour, does the other party get a right to put a manhani case, if we take another step to get rid of the problem?



Is there any provision in law that if the girl wants a divorce and she has not stayed for even a single day with him, but the guy is not ready to give the same, does she get any benefit. All my neighbourhood is in my favour and had given statements that we were not married nor did I stay there for even a single day?



My lawyer wants to appeal further. What is your suggestion to me to get rid of this problem, and that guy is not ready to relieve me and wants to take revenge?
