I was divorced in AZ in 2006. My ex was assigned a credit card debt, but my name is also on the card. He has not made a payment in the past 3 months and the creditors are beginning to come after me.
I now live in RI. He now lives in WA and is planning to file bankruptcy, foreclose on the house in AZ (in his name). His bankruptcy attorney tells him that because there is a court order saying he is responsible for the debt that it will clear the card. It is my understanding that I will become responsible for the entire debt if he declares bankruptcy. I have spoken to lawyers in RI, who tell me that they cannot do anything b/c it is not RI juristiction. I have spoken with lawyers in AZ, who suggest having him held in contempt of court and garnishing his wages. I have spoken with lawyers in WA, who cannot get involved unless he actually files the bankruptcy proceedings. If you have any alternative suggestions other than holding tight or paying his debt and then taking him to court, please advise. Best, Jaime |
