My ex-husband was ordered to pay me half of his Air Force retirement pay. We were married 7 out of the the 16 years he was in service, so the Air Force will not send me my amount automatically. He has been taking taxes out BEFORE he divides the pay. According to the original clerk that began my allotment and from what I have researched, he should be sending me half of the gross amount since he has no allowable deductions such as disability, etc. I am trying to file in the Arizona court to make him pay what he is suppose to, but I'm not sure which paperwork to file. The only form I can find at the self-help center is an order to make someone obey a court order for division of property. I'm not sure if Air Force retirement falls under property. I thought of filing in Small Claims, but I don't want it to get kicked back to Family Court and waste my money and time in the process. I'd like to get it done right the first time. I can't afford a lawyer. As it is, I will have to file for postponement or waiver of court fees. What paperwork do I need to file?

Why in Gods name does he have to pay you his Air Force Retirement that he worked for????? Do you have to give him 1/2 of anything? The judicail systems in the US suck for men. That is ridiculous. Leave the guy alone. He worked his but off for it. Go get a job and support yourself.

The family law court will enforce the order and he will be in contempt if he does not pay as ordered.
Have lawyer confirm how he is to pay, and then tell your ex to pay or hold him in contempt. Pensions and retirement are divided when couples divorce. It is your right to collect. |

Please do not waste your time raising irrelevant arguments such as "facts" with Angel. Such eccentricities do not factor into her opinions.

It's interesting that angel assumes that I am not working. I got no child support or alimony when we divorced. I didn't ask for half of his retirement either. He offered it to me, and he put it in the divorce settlement. His decision. I am supporting his son who is trying to get through college. All I need to know is what paperwork to file.

Then you should have said no thank you just support your son. And if he offered it why would you file a contempt charge against him? TBTYE get lost you useless peice of nothing. Go back to your mommy where you belong.
