Annullment of Transgender Marriage in Canada
In 1998, prior to Canada recognizing same-sex marriage, my partner and I married in Canada. We are both U.S. citizens. I am transgendered and have not had sexual reassignment surgery so I am female bodied. My spouse is also female. When we married I presented myself as male and produced legal documents supporting it. We have since separated and have now lived apart since September 2006. I live in CA and she lives in MI. Is it possible to have our Canadian marriage annulled based on the issue of same-sex or do we need to go through divorce proceedings since I presented myself as male? I am still transgendered and have now legally changed ALL my documents to Male vs. Female.

I am almost sure that you will be advised to get a divorce to eliminate any potential claims or confusion. This type of issue happens as well in certain religious and/or international marriages where confusion exists about the actual status of the marriage etc. |
