Need divorce but pregnant, seen pregnant women bet divorced..Help!!!
My husband and I have been seperated since february, no contact with one another during that time. I decided to start dating and moved in with my boyfriend who resides in Missouri, I am from Ohio, I am pregnant with his child, which was conceived in the middle of march. there is no doubt he is the father, as I have only been with him and he is even willing to sign a legal document that he is the father. In this state you can not get a divorce is pregnant, they state its not in the best interest of the child, because paternity needs to be established by DNA. Unfortunately with myself still being married my boyfriends insurance (the babies father) will not except the baby once he/she is born without a paternity test. Because in this state the name of the birth certificate automatically defaults to the husbands name until paternity proves otherwise. I am unable to put the baby on medicaid because my boyfriend, whom I live with makes $100 too much a month. So my baby will be uninsured for some time until paternity can be established and the name on the birth certificate can be changed. So it would not be in the best interest of the child to be uninsured as we cant afford the medical bills out of pocket. My Lawyer is putting me in front of a judge who will hear my case
Does it sound like something a judge would approve? And have I proven that its in the best interest of my child?

It would seem to me you may need to buy temporary coverage for the child and yourself if any such gap exists.

i would say that sounds like south carolina; a lot. if i were you i would go see a judge. all you have to do take all of your info w/ you. it sounds like you should win. if you don't mind: why are you getting a divorce?? i would make your marriage sound as bad as possible to insure you are getting a divorce for the best of the child. judge's these days seem to be too rushed when you go into court. everyone takes 20 secs. to hear your case and make a decision that will effect the next however-many YEARS of your life. seems unfair. just make your affidavit really; really good.
