Default divorce and finances?

me and husband are going through a divorce, I still do not have a lawyer, but in the process, we live in the state of Texas, and he just pulled 100,000 from our checking account, and he does not say where he has moved it, he left our accoutn with only 3,000.00 will this come back to him in the end? Also he is only a resident, since he was here illegally until I married him. He has an abusive past, has been to jail for hitting me while pregnant, but this happened while living in california. Will this play a part int he state of texas as well? There is alot of money and investments involved, and It hink thats all that matters to him. We have two kids, and have been married for 6 years? I am scared, and worried he will be able to get away with the money he pulled from our joint accounts.

Default Re: divorce and finances?

You will certainly want to get documentation from the bank that he withdrew these funds. They will be part of the divorce settlement.
If you need these funds for immediate living expenses, I'd think you could motion the court to make him return half of them, but only after one of you has actually filed for divorce.
Get yourself an attorney immediately. He and his attorney are already starting to play games with you.
