Hi, a relative of mine would like to find out if it is possible to gain a tourist visa to enter Australia even though they have an adverse visa history. They over-stayed their tourist visa about 15 years ago and were forcably deported. They have since repaid the costs of deportation to the Australian Immigration Department but they are not sure if there would still be a problem tring to get a tourist visa now. Can anybody advise please?

Hi Dave,
Whether or not one can come back is a question of why the person was deported and under what section of the Migration Act that person was deported. For example, if a person was deported under s200 of the Migration Act then: EXCLUSION PERIODS FOR PERSONS DEPORTED UNDER S 200 12.1 Persons deported under s 200 of the Act are permanently excluded from re-entry into Australia (Special Return criterion 5001 of the Migration Regulations). Reasons for their exclusion include: . the decision to deport is often based on an assessment that the person represents an unacceptable risk to the Australian community, either because their criminal activities were so abhorrent, or because it was considered likely that they may have continued to lead a life of crime;....... But if the deportation was for other reasons then the exclusion period may have been 12 months to 3 years. Hello again Dave,
I re-read your message, and if overstaying was the only issue that he/she should definitely have no problems getting a visa 15 years later. The usual exclusion period for that kind of breach is 3 years. Just make sure that he/she doesn't overstay again, doesn't breach any of the visa conditions, and declares everything that needs to be declared truthfully. Hi Veronika,
My friend has the same problem(overstayed on student visa)and it happened 20 years ago, he handed himself in and was held in the detained centre for couple of months before deported back to his country. He has yet to pay back anything to the Australia government as he claimed that he didn't receive any invoice until now. He is now planing to visit Australia again for holiday and got the travel agent to apply the ETA visa and is approved but he is worried that he will not be allowed entry when he arrives. Hi, I am saeed. I had applied as conventional refugee in canada 6 years ago and was refused and issued the deportaion order. My question is that can I apply for Australian skilled immigration points system fearing that I had been deported from canada because my refugee application was rejected. I have done nothing illegal in canada no crime etc. Please guide me.
Am I eligible to apply to australian immigration. |

Hi, i have a friend who was deported about 3yrs ago he was at the detention centre for 1month or 2 before he was sent back to his own country. The reason why he was deported was he was driving his car and a cop car were doing random breath test, so he showed his passport and they got him that way. it expired by 1month i think but it wasnt by that much. Is it possible for him to come back to the country or what will be his option to come back weither its for a visit or to live here. I hope to get some help as i dont know what my options are to help him out, Thanks
