Question Deportation and confiscation of the real estate property

Can US Government legally confiscate a real estate property of an illegal immigrant who was residing in the US for the period of over 10 years? He was paying taxes and besides being illegally present in the US, did not commit any other crime. Right now, he is being detained and in the process for deportation to the country of origin by the Immigration and Customs Enforcement due to misrepresentation by the Legal Advisor. Any advice could be helpful.
